Terms of Service

Effective November 1, 2026

Please read these Terms carefully. They include the rules for acceptable use of Better Scrape, how payments work through our merchant of record Polar, and how subscriptions renew, cancel and are refunded.

1. Agreement and accounts

These Terms of Service (“Terms”) are an agreement between you and Ibrahim EL Ouadifi, doing business as Better Scrape(“Better Scrape”, “we”, “us”), Rabat, Morocco, Morocco. They govern your use of the Better Scrape website, platform, API, browser extension and related services (the “Service”). By creating an account or using the Service you accept these Terms and our Privacy Policy. If you use the Service for an organization, you accept them on its behalf and confirm you are authorized to do so.

You must be at least 18 years old, or the age of majority where you live. You are responsible for your account credentials, for the members you invite to your organization and their roles, and for all activity under your account and API keys. Tell us promptly at [email protected] if you suspect unauthorized access.

2. The Service

Better Scrape lets you configure extraction blueprints (“sitemaps”), run them in cloud browsers on demand or on a schedule, and export the results. It is a tool for extracting publicly available data that you are entitled to collect.

The Service respects each site’s robots.txt rules and spaces requests to the same site. It does not solve CAPTCHAs and does not get past logins or paywalls. Pages a site keeps refusing are recorded as failed, with a screenshot.

We may change, add or remove features. We will give reasonable notice of changes that materially reduce a paid feature you rely on.

3. Acceptable use

You are solely responsible for what you collect with the Service and how you use it, and for having the legal right to do so. You agree not to use the Service, or help anyone else use it, to:

  • circumvent CAPTCHAs, logins, paywalls, rate limits, IP blocks or any other technical measure a website uses to control access;
  • access data or systems without authorization, or collect content behind a login unless you own that account and the site’s terms allow automated access;
  • breach the terms of service or rules of the websites you collect from, or ignore their robots.txt instructions;
  • place an unreasonable load on any website or interfere with its operation;
  • collect, combine or expose personal data in violation of privacy law (including the GDPR and CCPA), or build people-search, OSINT or profiling services about individuals;
  • sell, resell or distribute personal data collected with the Service, or use it for spam, unsolicited marketing, lead generation or automated outreach;
  • download media from YouTube, Instagram, Snapchat, TikTok or similar platforms, or otherwise infringe copyright, trademark or other rights;
  • engage in fraud or deceptive practices, or any activity that is illegal where you, we or the target website operate, including breaches of sanctions or export controls;
  • probe, attack or overload the Service, reach internal or private networks through it, or share accounts to evade plan limits.

We may investigate suspected violations, stop jobs, and suspend or close accounts that breach this section, with or without notice depending on the severity. Report abuse to [email protected].

4. Your content and data

You keep all rights in the sitemaps you create and the data you collect (“Customer Data”). You grant us a limited license to host, process and transmit Customer Data only to provide and secure the Service, as described in our Privacy Policy.

For personal data contained in Customer Data you are the controller and we act as your processor. You confirm you have a lawful basis to collect and process it. We store results to run the Service, not as a backup: export anything you need to keep.

5. Payments through Polar

Our order process is conducted by our online reseller Polar Software, Inc. (“Polar”). Polar is the merchant of record for all our orders: it sells the subscriptions and credit packs to you, processes payment, charges and remits sales tax or VAT, issues invoices, and handles billing questions, cancellations and refund requests.

Your purchase is also subject to Polar’s Checkout Buyer Terms and Privacy Policy. We never see or store your full payment card details.

6. Plans, credits and renewal

  • Plans are billed per organization, monthly or yearly. The price, billing interval, included credits and concurrency are shown before you pay.
  • Subscriptions renew automatically at the end of each billing period, and you will be charged the then-current price until you cancel.
  • You can cancel at any time from the Billing page of your organization, or from the Polar customer portal linked there and in your receipt. Cancellation takes effect at the end of the current billing period; you keep access until then.
  • Upgrades apply immediately; downgrades apply at the end of the current period. Plan credits are granted each period. Credits from one-time credit packs do not expire and are used after plan credits.
  • A free trial, where offered, comes with a limited number of credits and does not renew into a paid plan automatically.
  • We may change prices with at least 30 days’ notice. A new price applies from your next renewal; you can cancel before it does.

7. Refunds

  • Credit packs: you may request a refund within 10 days of purchase for credits that have not been used.
  • Subscriptions: you may request a refund within 30 days of your most recent charge. Refunds may be prorated or reduced for credits already used in that period.
  • Charges for billing periods that have ended are not refundable, except where the Service was not provided or the law requires.
  • Requests are reviewed and issued by Polar under its Checkout Buyer Terms. Contact Polar at [email protected] or reply to your receipt; you can also write to us at [email protected] and we will pass it on.
  • Please contact Polar or us before disputing a charge with your bank. Your statutory rights, including any right of withdrawal under consumer law, and your card issuer’s chargeback rights are not affected.

8. Support

We provide product and technical support at [email protected]. Polar provides support for payments, invoices, cancellations and refunds. If the Service is unavailable for a significant part of a paid period through our fault, contact us for a prorated credit or refund.

9. Suspension and termination

You can stop using the Service at any time and ask us to delete your account by writing to [email protected]. We may suspend or terminate your access if you breach these Terms, fail to pay, or if your use creates legal or security risk for us, other customers or third parties. Where reasonable we will give notice first. After termination we delete Customer Data as described in our Privacy Policy. Sections that by their nature should survive termination (including acceptable use, disclaimers, liability and indemnity) do so.

10. Our intellectual property

The Service, its software and branding belong to us and our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms during your subscription. Do not copy, resell or reverse engineer it, except where the law allows. Feedback you send us may be used without obligation.

11. Disclaimers

The Service is provided “as is” and “as available”. Websites change and may refuse access, so we do not guarantee that any site can be collected from, or that results are complete, accurate or uninterrupted. To the extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

12. Limitation of liability

To the extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability arising from these Terms is limited to the amounts you paid for the Service in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnity

You will defend and indemnify us against third-party claims, fines and costs arising from Customer Data, from the websites and data you choose to collect, or from your breach of these Terms or of law.

14. Changes to these Terms

We may update these Terms. For material changes we will notify account owners by email or in the platform at least 30 days in advance. Using the Service after the effective date means you accept the new Terms.

15. Governing law

These Terms are governed by the laws of Moroccan law, and its courts have jurisdiction, without prejudice to mandatory consumer protections in the country where you live. Purchases are also governed by Polar’s Checkout Buyer Terms.
